MINORS – WAIVER, RELEASE OF LIABILITY, INDEMNIFICATION & ASSUMPTION OF RISK AGREEMENT

In consideration of being permitted to participate in events known as North American Long Range Shooting Association, LLC., located in Bandera Texas and to participate in and/or observe a shooting sports event at the above-named association, the undersigned, individually and/or in his/her capacity as parent/guardian/legal custodian for his/her minor child (children) identified, for himself/herself, his/her spouse, his/her child (children), his/her guests, legal representatives, heirs and assigns WAIVES, RELEASES AND FOREVER DISCHARGES the North American Long Range Shooting Association, LLC., and its’ officers, directors, shareholders, committee members, employees and each of them, together with any corporate and/or charitable entity sponsoring an event, its officers, directors and employees from ALL LIABILITY to the undersigned releasor, his/her spouse, his/her child (children), his/her guests, legal representatives, heirs and assigns, of and from any and every claim, demand, action of whatever kind or nature, either in law or in equity, arising from or by reason of loss, bodily injury or personal injuries known or unknown, death or property damage or damage of any kind resulting; or to result from an incident or accident that may occur from his/her presence or participation, or his/her child (children)’s presence or participation in a shooting sports event hosted by North American Long Range Shooting Association, LLC., or any activities in connection with and whether by any such parties’ negligence or not.

The undersigned understands and acknowledges that shooting sports involve the discharge of firearms and that there are many hazards and dangers associated with the observation and participation in shooting sports activities. Further, the undersigned understands and acknowledges that the above-mentioned entity, their employees and officials, or otherwise, make no representation or warranties, express or implied, as to the safety training or shooting knowledge of safe firearms practices of any of the participants at any event. Therefore, the undersigned assumes full responsibility for the risk of bodily injury, death, personal property damage or other loss of any kind to himself/herself, his/her spouse, his/her child(children), his/her guests that may occur during or as a result of the observation or participation in a shooting sports event, whether such risks are foreseen or unforeseen and whether or not the same is caused by negligence of any of the above-mentioned entities, their employees and officials, or otherwise.

The undersigned further agrees to indemnify the above-mentioned entity and all its’ officers, directors, shareholders. committee members, employees and each of them, from any loss, damage or cost they may incur due to the undersigned’s, or the undersigned’s minor child(children)’s observation or participation in a shooting sports event.

This WAIVER, RELEASE OF LIABILITY, INDEMNIFICATION & ASSUMPTION OF RISK is intended to be as broad and inclusive as permitted by the laws of the State of Texas, and if any portion is held invalid, it is agreed that the balance shall, notwithstanding, continue in full force and effect. The undersigned further states that he/she has carefully read this document and knows the contents thereof and has signed this document as his/her own free act.

The undersigned has executed this document on the date stated below and intends for this document to be valid until revoked in writing.

Firearms

1. Safety is always NALRSA's priority.
2. All rifles will be unloaded with magazines out and bolts open at ALL times.
3. Chamber flags will be used at ALL times. Once the rifle leaves your vehicle, chamber flags can not be removed until on the mat with muzzle pointed safely down range. The flag must be re-in stalled when leaving the mat.
4. Always treat every firearm as if it is loaded. (Yours and fellow competitors')
5. Always keep muzzle pointed in a safe direction (Rule #4)
6. If a gun misfires, do not open the bolt. Wait for range officer instructions.
7. Gun must stay in your vehicle until you are staging for your assigned rotation.
8. Shooter must fire from designated shooting lanes in a prone shooting position. (only exception is listed in NALRSA Rules #3)
9. Any competitor who is found tampering with a fellow competitor’s equipment will be disqualified from the competition.
10. Competitions will be run only on cold ranges (Cold range is defined as firearms being unloaded until the competitor is on the mat and it is his or her turn to shoot) Rule #3 this section.

Equipment

1. Overall equipment weight: The combined weight of all equipment to be used in the competition cannot exceed 21 pounds and 15 ounces. (under 22 pounds) This will include anything attached to the rifle, or anything that will be used in any way to aid in firing the rifle. This will also include any legal front and rear rest. You will only be allowed to enter the shooting lanes with items used to complete the round and have been weighed. (the only exclusion to total weight will be a suppressor and the ammunition) You will be allowed to take 10 rounds of ammo to the lanes in ammo boxes, sleeves etc. More than 10 rounds at a time will result in disqualification.
2. No F-Class or Benchrest style rifles will be allowed. No single shot actions will be allowed. (All rifles must be magazine feed repeaters with ability to hold more than one round, either by box magazine or internal.) Rifle must also utilize a working mechanical top safety.
3. No monolithic solid Lathe (CNC) turned bullets will be allowed. Only conventional Target or Hunting style bullets are accepted.
4. Only folding front bipods will be allowed. Bipods wingspan can be no wider than 15” foot to foot.
5. A competitors rifle will be limited to 30 caliber with a maximum of 4200 ft/lbs of energy at the muzzle. This max is set not to inhibit shooters but to keep our targets from malfunctioning. Velocity may be verified via a Labradar during final round. A competitor may have a bullet pulled, and weight verified to determine max ft/lbs of energy. Violations of this rule will be disqualified.
6. Mechanically adjustable rear rests will not be allowed.
7. No more than two rests may be used, and must be independent of each other. (No sleds or joy sticks)
8. No mechanical method allowed that would return the firearm to the exact point of aim from prior shot.
9. Semi-automatic guns must utilize a brass catcher.
10. No electronic guided shooting systems, i.e., tracking point

General

1. No one will be allowed past the marked firing line at any time for any reason.
2. No unattended children at any competition at any time.
3. No more than one shooter under the tent at a time in firing lanes.
4. No spotters allowed. (Electronic targets will show POI and score.)
5. Hearing protection is required once a shooter leaves staging area.

NALRSA RULES:

1. Competitors must be at least 18 years of age.
2. Absolutely no drugs or alcohol.
3. A competitor must shoot prone , unless he or she has entered carrying a disable status. (Must carry a handicap status or have a note from a physician) If a contestant is over the age of 60, he or she also has the option to shoot from a bench. (Preference chosen when entering as a member)
4. Unsportsmanlike conduct includes, but is not limited to: arguing with other competitors or officials, throwing things, displaying tantrums, or initiating unwarranted complaints. (NALRSA reserves the right to make the determination as to what constitutes “unsportsmanlike” conduct.) Any competitor deemed unsportsmanlike can be warned or disqualified on the spot.
5. In case of a tie: Ties for 1st and 2nd will go into an immediate sudden-death shoot off. A tie from 3rd through 12th will split prize money.
6. Dress Code: Proper attire will be required. Keep in mind, at any time you may be televised. Attire must be respectful of other shooters and spectators. No offensive or vulgar pictures or graphics on clothing will be allowed. Sponsor jerseys are not only accepted, but encouraged. (At any point, a match representative can ask you to change attire to comply with NALRSA dress code)
7. During a Format 1 competition, only 1 rifle can be used thru all 3 rounds. Multiple rifles for different rounds will not be allowed. Format 2 competitions, a shooter may enter more than one rifle. The rifle used in round 1, must also be used throughout rounds 2 and 3 for each entry. Shooters can enter up to 5 different guns. A competitor will only be allowed to shoot one gun/ entry in the final round. (Short-Go)

Rules and Regulations for Mechanical Failure

If a shooter suffers a mechanical failure while shooting a (Round), they should do the following:

1. Immediately unload and clear your rifle.
   *** If there is a live round stuck in the chamber, your rifle cannot leave the firing line until it is removed.
2. Notify a range officer as soon as it is practical (you may need to wait until the round has finished).
3. Allow a range officer to verify the mechanical failure.
   *** If the range officer determines that your rifle is functioning perfectly, and user error was the cause, you will be DQ’d from the match.
4. All points acquired before the mechanical failure will be saved and added to the total of your remaining round when you return.

Rules for re-shoot

Upon confirmation by the range officer that a mechanical failure has occurred and your rifle is in a safe condition to leave the firing line, you will have the following option.

1. Repair your rifle.
2. Allow a range officer to confirm it is in a safe working condition.
3. You will be allowed to shoot and be placed at the end of the current Round.
4. If you were a shooter in the final rotation, you will have 10 minutes to repair the failure and report back to the line.

Protests/DQ/Expulsion

1. Protests: All protests will be made within 30 minutes of occurrence. All protests will be made directly to the match director (MD), and only shooters are eligible to protest. The match director’s decision is final at the competition.
2. Range officers (RO) will enforce all rules. Any contestant issue in regards to rules or treatment will be reviewed by match director (MD). The match director’s decision is final at the competition.
3. DQ/Expulsion: Match director (MD) can have a contestant disqualified and/or barred from a competition and association for reasons listed, but not limited to the following:
   1. Endangering the safety of shooters, RO’s, field personnel or spectators. Example: throwing things or sweeping the gun muzzle at contestants, spectators or officials.
   2. Misrepresentation of his or her status or eligibility.
   3. Physically assaulting or directing abusive language toward anyone on the grounds of a NALRSA competition.
   4. Repeated violations or warnings from officials regarding any NALRSA rules.
4. A competitor may file a formal protest in writing. The complaint/protest must be filed within 7 days of the conclusion of the competition. The Board of Directors of NALRSA will review and reach a final decision within 30 days.

RELEASE, WAIVER, INDEMNIFICATION AND HOLD HARMLESS AGREEMENT

 This Release, Waiver, Indemnification and Hold Harmless Agreement (“Agreement”) is hereby made and entered into by and between NORTH AMERICAN LONG RANGE SHOOTING ASSOCATION, LLC (hereinafter sometimes referred to as “NALRSA”) and ________________________________________________________ (member of North American Long Range Shooting Association, LLC and/or participant in NALRSA event).

I, the undersigned, along with my immediate family, heirs, successors, assigns, executors and administrators, for and in consideration of having been permitted to participate in the activities of the North American Long Range Shooting Association, LLC, including the participation in shooting events and competitions, do hereby agree to all the matters stated herein and I do RELEASE, WAIVE and FOREVER DISCHARGE NALRSA, its employees and agents, members, owners, directors, officers, volunteers, families, insurers, invitees, guests, successors and assigns, of and from all rights, claims, demands, debts and other liabilities, obligations, suits, damages (including reasonable legal fees and costs) and causes of action of any kind whatsoever, at law or in equity, known or unknown, arising before, on or after the date of this Release, Waiver, Indemnification and Hold Harmless Agreement, which I may now have or may ever have, in the future, against NALRSA, arising directly or indirectly from my participation in any activities, events, shooting events, or competitions, hosted or sponsored by NALRSA, irrespective of whether such claims, demands, debts and other liabilities, obligations, suits, damages and causes of action are due to the negligence, gross negligence, negligence per se, strict liability or other act, fault or omission of the NALRSA, or the concurrent/contributory negligence, gross negligence, negligence per se, strict liability, or fault of NALRSA. I expressly assume full responsibility for all losses, damages or claims for injury to myself, my immediate family members, guests, and other participants or members.

I agree to the following and I further represent that all of the following are true and correct:

1. Prior to accepting membership in, and participating in events hosted or sponsored by, NALRSA, I shall make myself fully aware of all firearm laws, rules, and regulations of the state and county in which the event or competition takes place, as well as any applicable federal laws. Prior to entering NALRSA’s event or competition, I shall obtain all permits and/or licenses required by law or regulation as a prerequisite to carrying, possessing, or shooting a firearm in NALRSA’s event or competition.

1. NALRSA has not provided me any firearm, ammunition, or equipment. I have or will provide my own firearm, ammunition, and equipment.

1. Prior to participating in NALRSA’s event or competition, I will take all reasonable precautions to protect myself from injury, including, but not limited to, following NALRSA’s safety rules, firing range rules, and wearing the appropriate eye, ear, and body protection. NALRSA is not responsible for my own failure to follow any safety rules or laws, or my failure to wear protective clothing or equipment.

1. I acknowledge that the participation in shooting events and competitions, using firearm’s in general, as well as being around others with firearms, and attending events at locations where firearms will be discharged have inherent risks, hazards and dangers for anyone, which cannot be eliminated. I understand that these risks, hazards, and dangers include, without limitation: (1) the risk from handling firearms and being near others that have firearms in their possession; (2) the risk of being shot by my own or another person’s firearm; and/or (3) the risk of being hit by a stray bullet and/or ricochets.

1. I have seen and examined the shooting range and/or competition course. I accept the condition of the shooting range and/or competition course, and I shall be solely responsible for any loss or injury that might be incurred by me or my property as a result of my acts, errors and/or omissions during my use and/or occupancy of the shooting range and/or competition course.

1. I am familiar with firearms in general and I am familiar with my firearms in particular. I am fully responsible and liable for any injury to persons or property as a result of the use or misuse of any firearm by me or the person who might use my firearm.

1. I am an experienced firearm user and/or competition shooter. I have experience in firing the type of firearm typically used in this NALRSA event or competition. I fully appreciate the high risks, hazards and dangers of using and firing these types of firearms in these events and competitions, and I assume such risks. I have not been induced by anyone to participate in this NALRSA event or competition. I have requested the right to participate in this NALRSA event or competition, and I do so voluntarily in spite of the risks. I understand that participation in this NALRSA event or competition may require good physical conditioning and a degree of skill and knowledge. I have the necessary physical conditioning and the degree of skill and knowledge required for me to engage in these activities safely.

1. I am aware that the NALRSA event or competition is located in a semi-remote area of the state and that medical treatment and facilities are not readily accessible and that in the event of injury or illness, I will not have immediate access to medical or professional care and that I would have to transport myself or find someone to transport me to the nearest physician, hospital, or clinic. Furthermore, if I am on medication or if I need medication, NALRSA shall not be responsible for providing medication or transportation to get medication. Also, NALRSA is not responsible for transporting me to a physician, hospital, clinic, or pharmacy that might provide me with medicine or treatment.

1. I agree not to consume alcoholic beverages, or other drugs, before participating or during participation, in the above mentioned activities and I agree to remain in a sober state during the activities.

1. The activity, event, or competition I am participating in is controlled, operated, or sponsored by the North American Long Range Shooting Association, LLC. The NALRSA’s offices are within the State of Texas, United States of America. Participation in this event and the execution of this form constitutes a contractual agreement with the North American Long Range Shooting Association, LLC and is governed by this Agreement. The parties agree that this Agreement is made and is performable in Brazos County, Texas and that exclusive venue for all disputes and litigation arising out of or in connection with this Agreement shall be in the state or federal courts located in Brazos County, Texas, and that both parties hereby consent and submit to the personal jurisdiction of such courts. This Agreement shall be governed by and construed in accordance with the laws of the State of Texas, without giving effect to any principles of conflicts of law or your actual state or country of residence, or the location of the shooting event or competition. Any party who unsuccessfully challenges the enforceability of this forum selection clause shall reimburse the prevailing party for its attorney’s fees, and the party prevailing in any such dispute shall be awarded its attorney’s fees. The parties to this Agreement agree that the North American Long Range Shooting Association, LLC has in no way purposefully availed itself to the jurisdiction of your actual state or country of residence.

1. I shall be liable and responsible for, and I HEREBY AGREE TO indemnify SAVE, defend NALRSA, ITS employees and agents, MEMBERS, OWNERS, DIRECTORS, OFFICERS, VOLUNTEERS, families, INSURERS, INVITEES, GUESTS, successors and assigns, and hold them harmless from any claim, demand, liability or cause of action arising out of my negligence, gross negligence, negligence per se, strict liability or any other acts, omissions or errors while PARTICIPATING IN, OR WHILE IN ATTENDANCE AT, NALRSA’S EVENTS, COMPEITITONS, OR ACTIVITIES, or going to and from NALRSA’S EVENTS, COMPETITIONS, OR ACTIVITIES, or which may arise out of my use of any firearm, equipment, AMMUNITION, vehicle, SHOOTING RANGE FACILITY, ALL-TERRAIN VEHICLE, or my consumption of any food, drink OR alcoholic beverage. I AGREE TO INDEMNIFY NALRSA AS STATED ABOVE regardless and irrespective of whether such liability results from the negligence, NEGLIGENCE PER SE, STRICT LIABILITY, gross negligence or misconduct of NALRSA, ITS EMPLOYEES AND AGENTS, MEMBERS, OWNERS, DIRECTORS, OFFICERS, VOLUNTEERS, FAMILIES, INSURERS, INVITEES, GUESTS, SUCCESSORS AND ASSIGNS.

1. I AM VOLUNTARILY PARTICIPATING IN THE ABOVE MENTIONED ACTIVITIES WITH FULL KNOWLEDGE OF THE INHERENT RISKS, HAZARDS, AND DANGERS INVOLVED AND HEREBY ASSUME AND ACCEPT ANY AND ALL RISKS OF INJURY, PARALYSIS, OR DEATH.

1. I acknowledge that I have read this document and I fully understand that I am executing a full Release, Waiver, Indemnification and Hold Harmless Agreement.
